Man accused of throwing heroin into air when Garda entered room

A man has been charged with throwing a quantity of heroin into the air when a Garda entered his bedroom on New Year’s Day, causing the white powder to fall on the Garda’s clothes and shoes.

Gerard Rabbitte (31), 96 Innishannagh Park, Newcastle, Galway, appeared before Galway District Court.

He is charged with impeding and obstructing Garda Lena Walsh in that when she entered his bedroom on January 1 last, he threw a quantity of heroin up in the air, causing the white powder to subsequently scatter on the floor, radiator, bowls and on Garda Walsh’s clothes and shoes.

Rabbitte is also charged with having the heroin for sale or supply to others on the same date.

He is further charged with impeding Garda Walsh while later being interviewed at Galway Garda Station on the same date by taking possession of an exhibit of heroin and placing it down his pants.

Garda Noel McNulty gave evidence or arresting and charging Rabbitte with having heroin in his possession and having the drug for sale or supply to others at his Innishannagh address on August 24 last year.

Rabbitte faces additional charges of the theft of a €2,500 laptop, a handset and games from a premises at Burke’s Lane, Dominick Street on April 16 last year and with handling the property knowing it was stolen on the same date at Shantalla Road.

The court heard the DPP had directed the heroin dealing charges be sent forward for trial.

Judge Mary Fahy remanded Rabbitte on continuing bail on all charges to appear back before her court again on May 15 for service of a Book of Evidence.
